L. 2016 No. 119, p. 1 as amended).<\/li><li><strong>Service<\/strong> - website available at <a href=\"https:\/\/rulity.pl\/en\/\">https:\/\/rulity.pl<\/a>.<\/li><li><strong>Consumer Rights Act<\/strong> - Act of 30 May 2014 on consumer rights (i.e. Journal of Laws 2024, item 1796).<\/li><li><strong>Act on Provision of Services by Electronic Means<\/strong> - Act of 18 July 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2024, item 1796).<\/li><li><strong>User<\/strong> - an entity that uses the Website and\/or the services provided electronically (within the meaning of the Act on Provision of Services by Electronic Means) by the Administrator as part of the Website.<\/li><li>The terms (with the exception of the Administrator) referred to above, which are used in the body of the Terms and Conditions, in the plural, shall also apply accordingly to the singular and vice versa.<\/li><li>In the case of the use in the Rules and Regulations of proper names with a capital letter and not indicated in this paragraph of the Rules and Regulations, their definition indicated in the applicable provisions of Polish law shall be adopted.<\/li><\/ol><p>\u00a0<\/p><h6>\u00a7 2 Data of the Administrator<\/h6><ol><li>The administrator is <strong>RULITY CONSULTING SP\u00d3\u0141KA Z OGRANICZON\u0104 ODPOWIEDZIALNO\u015aCI\u0104<\/strong> with its registered office at ul. Che\u0142mo\u0144skiego 22\/1, 60-756 Pozna\u0144, entered in the register of entrepreneurs kept by the District Court Nowe Miasto and Wilda in Pozna\u0144, VIII Economic Division of the National Court Register, under KRS number: 0000893846, holding NIP: 7812019625, with the share capital of PLN 5,000.00.<\/li><li><strong>Address for correspondence: ul. Che\u0142mo\u0144skiego 22\/1, 60-756 Pozna\u0144.<\/strong><\/li><li><strong>Contact e-mail address: biuro@rulity.pl<\/strong><\/li><li><strong>Contact phone: +48 609 555 023, the cost of the call corresponds to the user's operator's rate.<\/strong><\/li><\/ol><p>\u00a0<\/p><h6>\u00a7 3 General provisions<\/h6><ol><li>In particular, the Regulations indicate:<ul><li>rights and obligations of the Administrator and the User,<\/li><li>technical requirements for using the Website,<\/li><li>terms and conditions for the use of electronic services, in particular the contact form, including complaints about such services,<\/li><li>rules related to the content on the Website,<\/li><li>responsibility of the Administrator and the User,<\/li><li>data protection provisions,<\/li><li>provisions for user opinions and content,<\/li><li>the terms and conditions for dispute resolution, including out-of-court dispute resolution methods,<\/li><li>provisions concerning amendments to the Rules of Procedure.<\/li><\/ul><\/li><li>These Regulations are also the regulations referred to in Article 8 of the Act of 18 July 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2024, item 1513).<\/li><li>Acceptance of the provisions of the Terms and Conditions is a condition. By using the Service, the User accepts all provisions of the Terms and Conditions and undertakes to comply with them. Acceptance of the Terms and Conditions is voluntary but required, inter alia, for the Administrator to provide electronic services.<\/li><li>The User may access the Terms and Conditions at any time via a hyperlink or a link to a web page, either on the Website or in an email sent. The User may download the Terms and Conditions and make a printout or save them on a durable medium.<\/li><li>The provisions of the Terms and Conditions do not exclude or limit any of the consumer's rights in relation to Consumers or and Entrepreneurs in their capacity as consumers that they are entitled to under applicable law.<\/li><li>Use of the Website requires access to the Internet, a device equipped with a browser that supports Java Script and cookies, and an active e-mail address.<\/li><li>The Administrator is not responsible for interruptions in the availability of the Service for reasons beyond the Administrator's control, in particular those constituting force majeure (e.g. fires, floods, natural or meteorological disasters, pandemics, riots).<\/li><li>The Administrator shall not be liable for any infringement of the rights of others by the User within the Service.<\/li><\/ol><p>\u00a0<\/p><h6>\u00a7 4 Services provided electronically<\/h6><ol><li>The Administrator makes it possible, free of charge, to use services provided electronically (as defined by the Electronic Services Act) via the Website, including the use of the contact form contained in the Website, in the \u201eContact\u201d tab.<\/li><li>The User, when filling in the contact form, enters into a contract with the Administrator for the provision of services for a fixed period of time, which is terminated as soon as the message is sent or the Service Recipient stops sending it. The contract is concluded electronically and requires acceptance of the Terms and Conditions.<\/li><li>The User undertakes to provide his\/her personal data truthfully and not to include unlawful content on the Website (including the contact form).<\/li><li>The Administrator has the right to place advertising content on the Website. Such content is an integral part of the Website and the materials presented therein.<\/li><li>The Administrator may withdraw from the contract for the provision of electronic services to the Entrepreneur within 14 days of its conclusion, without giving any reason.<\/li><\/ol><p>\u00a0<\/p><h6>\u00a7 5 Complaints about services provided electronically<\/h6><ol><li>Complaints In accordance with the Act on Provision of Services by Electronic Means, the User has the right to lodge a complaint with the Administrator regarding the services that the Seller provides by electronic means (complaint), including the contact form service.<\/li><li>The User may submit complaints relating to the services provided electronically on the Website by e-mail, telephone or letter to the data indicated in \u00a7 2 of the Terms of Use.<\/li><li>In a complaint notification, the User should provide his\/her name, contact details, type and date of the noticed irregularity related to the services provided by the Administrator electronically within the Service.<\/li><li>If there are any deficiencies or errors in the complaint application, the Administrator may call on the User to supplement or amend the complaint application within the time limit specified in the call.<\/li><li>Complaints shall be considered by the Administrator without delay, but no later than within 14 days of being reported.<\/li><li>The user will be informed of the complaint decision by means of a postal letter, e-mail or SMS to the details provided in the complaint application.<\/li><\/ol><p>\u00a0<\/p><h6>\u00a7 6 Copyright<\/h6><ol><li>Content that constitutes works within the meaning of the Act on Copyright and Related Rights of 4 February 1994 (i.e. Journal of Laws of 2022, item 2509, as amended) placed on the Website enjoy copyright protection vested in the Administrator. The Administrator holds copyright or a licence of an appropriate scope to the content on the Website.<\/li><li>The use of the aforementioned content on the Website without the express consent of the Administrator constitutes an infringement of the Administrator's copyright and may result in liability.<\/li><li>The User shall be fully liable for any damage caused to the Service Provider resulting from the use of any content of the Website without the Administrator's consent.<\/li><\/ol><p>\u00a0<\/p><h6>\u00a7 7 Personal data protection<\/h6><ol><li>In order to properly provide all services by the Administrator and to safeguard the legal interest of authorised entities, the Administrator collects, stores and processes Users' personal data.<\/li><li>The Administrator undertakes to protect the Users' personal data in accordance with the applicable legislation, in particular the RODO and the privacy policy, available on the Website or at: <a href=\"https:\/\/rulity.pl\/en\/polityka-prywatnosci\/\">https:\/\/rulity.pl\/polityka-prywatnosci<\/a>, which details the principles for collecting, storing and processing Users' personal data.<\/li><\/ol><h6>\u00a7 8 Dispute resolution<\/h6><ol><li>In the event of a dispute between the Administrator and the User, the parties will seek to resolve the dispute amicably (e.g. by negotiation), however, Consumers retain the right to resolve the dispute through a common court with jurisdiction according to the provisions of the Civil Procedure Code Act of 17 November 1964 (i.e. Journal of Laws of 2023, item 1550, as amended), i.e. a court with jurisdiction over their place of residence.<\/li><li>The consumer also has the right to use out-of-court complaint and redress procedures, including but not limited to:<ul><li>submit a request for the initiation of proceedings for the amicable settlement of a dispute with the Administrator to a regional inspector of the Commercial Inspection or a permanent amicable consumer court,<\/li><li>free-of-charge assistance from a county (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection - e.g. Polish Consumers' Association.<\/li><\/ul><\/li><li>The out-of-court method of dealing with complaints and claims in the form of dispute resolution by an arbitration court may only be used after the complaint procedure has been completed and with the consent of both parties to the dispute. Otherwise, disputes may be referred to the competent court of general jurisdiction in accordance with the applicable laws, including the Code of Civil Procedure.<\/li><li>The Administrator agrees to resolve disputes through a mediation process. Details of the dispute resolution process will be determined by the parties to the dispute.<\/li><li>Further information on out-of-court complaint and redress procedures can be found at <a href=\"http:\/\/www.uokik.gov.pl\">http:\/\/www.uokik.gov.pl<\/a>, The website of the district (city) consumer ombudsmen or at their offices, the website of social organisations whose statutory tasks include consumer protection or the website of provincial trade inspection inspectorates.<\/li><\/ol><p>\u00a0<\/p><h6>\u00a7 9 Amendments to the Rules of Procedure<\/h6><ol><li>The content of these Terms of Use is subject to change. The Administrator will inform Users of any changes by posting information on the Website.<\/li><li>The Administrator is obliged to notify of the planned change to the Rules and Regulations and to make the content of the new Rules and Regulations available on the Website at least 14 days before the new Rules and Regulations come into force.<\/li><li>Amendments to the Terms and Conditions may be made by the Administrator due to changes in legislation, the order of relevant state institutions, editorial changes or changes in the scope of electronically provided services.<\/li><li>In exceptional circumstances, in particular if the amendments to the Rules of Procedure result from a change in generally applicable law, the period referred to in the preceding paragraph of this section of the Rules of Procedure may be shortened in accordance with the circumstances justifying such a shortening.<\/li><li>The new Rules shall enter into force on the date specified in the notice of change of the Rules, subject to the preceding paragraph.<\/li><li>The provisions of the new Terms and Conditions and amendments to the Terms and Conditions shall not affect the User's acquired rights.<\/li><\/ol><p>\u00a0<\/p><h6>\u00a7 10 Final provisions<\/h6><ol><li>In matters not covered by these Terms and Conditions, the applicable provisions of Polish law, including the Civil Code, the Consumer Rights Act, the Act on Provision of Services by Electronic Means and the RODO Regulation shall apply.<\/li><li>Individual agreements between the Administrator and the User, concluded in writing, take precedence over the provisions of the Terms and Conditions to the extent that the parties have deviated from them.<\/li><li>The Rules shall remain in force until repealed or replaced by a new version.<\/li><li>The regulations shall enter into force on 29 January 2026.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>\u00a7 1.
