Why is it worth registering an industrial design?
An industrial design is more than just the aesthetics of a product — it holds real market value and offers a competitive edge. A registered design protects the external appearance of a product: its shape, colours, texture, or ornamentation. In many industries, design is the key factor influencing consumer choice. However, lack of proper protection may result in competitors exploiting your creation.
Legal basis for design protection
Industrial design registration is governed by the Polish Industrial Property Law Act of 30 June 2000 and Council Regulation (EC) No 6/2002 of 12 December 2001 on Community Designs. These are the two main legal instruments regulating design protection at the national and EU levels.
In Poland, designs are registered with the Patent Office of the Republic of Poland. For EU-wide protection, registration is handled by the European Union Intellectual Property Office (EUIPO).

Before filing for registration, ensure your design meets the key requirements: novelty and individual character. Many entrepreneurs unknowingly lose the chance to obtain protection by publishing their designs on websites or in promotional materials prior to filing. In such cases, the design may no longer meet the conditions for successful registration.
