Legal basis for design protection

Industrial design registration is governed by the Polish Industrial Property Law Act of 30 June 2000 and Council Regulation (EC) No 6/2002 of 12 December 2001 on Community Designs. These are the two main legal instruments regulating design protection at the national and EU levels.

In Poland, designs are registered with the Patent Office of the Republic of Poland. For EU-wide protection, registration is handled by the European Union Intellectual Property Office (EUIPO).

1. What exactly does a design registration protect?
An industrial design protects the aesthetic layer of a product, i.e. its unique external appearance. This includes, in particular, the shape, material structure, colours and ornamentation that give the product its individual character. Unlike patents, which protect technical solutions, a design protects the design from being copied by competitors. This gives you an exclusive right to use the design, which represents a real market value for your company.
2. why should a project not be published before it is submitted to the authority?
In order for a design to be successfully registered, it must fulfil the requirement of novelty. This means that an identical design must not have been made available to the public before. Premature publication on a website, on social media or in promotional materials can make the design lose its novelty under the legislation. Although there is so-called novelty relief, the safest course of action is to apply for protection even before a widespread marketing campaign is launched.
3. What are the advantages of registering a design at EUIPO instead of only in Poland?
Registering a design with the EUIPO provides uniform protection in all EU member states on the basis of a single application. This is an extremely cost-effective solution for companies planning international sales or presence on foreign marketplace platforms. Instead of having to conduct separate proceedings before national patent offices, you gain protection for your design throughout the EU single market. As a result, it is much easier to enforce your rights in the event that infringements are detected abroad.
